Which acts would result in the termination of an employment contract, and result in the employee being banned from working in the UAE for one year?

The following acts by the employee would render the employee banned from working in the UAE for a year.

1. If the employee leaves his employment without a justified cause before the end of a specified there in the employment contract; or

2. In the case of an unlimited contract without giving one month’s notice of termination; or

3. The employee leaves his employment before the lapse of one month’s notice; or

4. The employee violates Article 120 of the Law; or

5. The employee works with another employer full/part time at the same time as working for his original employer.

These sanctions would only be applied if a complaint was filed by the employer requesting such.

I was working for a company here. I was blacklisted forever due to a theft case in 2005. Now a company has appointed me at the Sharjah Hamriya & Jebel Ali free zone. Is it possible that I can get an employment visa on the company sponsorship for two years?

Blacklisting or a ban is a legal mechanism in the UAE that prevents a resident or an employee from re-entering into the UAE, or from accepting any employment position with a new employer for a fixed period of time.

Workers and visitors may be subjected to an entry ban or a work ban, depending on what they have done while they were in the UAE. Blacklisting or ban could be broadly categorised into two types i.e. employment ban and immigration ban.

In an employment ban, A person is not permitted to work in the UAE for a specific period of time due to breach of certain provisions of the UAE Labour Law. An employment ban is usually given under the following circumstances:

A permanent ban is usually imposed on absconding employees.

A ban for a period of six months will be automatically imposed by the Ministry of Labour, in case if a worker has not completed two years with his current employer. An immigration ban is usually imposed for serious labour offences or crimes committed by person. Therefore, an immigration ban means that one cannot enter the UAE, irrespective of whether the person intends to enter as a visitor or for residency. Since you were convicted of theft, an immigration ban was imposed upon you. Therefore, you will not be allowed to enter into the UAE.
I have been working in a company here on an unlimited contract. I have resigned recently with 30 days notice period. I would very much appreciate if you kindly advice me on the labour ban, if any, end of service benefits, and my passport which they kept with them.

First of all, the employer does not have the right to hold the employee’s passport without the latter’s consent. Secondly, according to Articles 125, 131, 132,133 and 137 your end of service benefits are; a certificate of service (free of charges), the expenses of sending you back to your home country (a ticket and any other agreed upon expenses according to the labour contract), and your gratuity would be the salary of 21 days for each year divided by three. Finally, Under the UAE laws, if an employee leaves a job without completing two years, then, the Ministry of Labour will impose a work ban for six months or for one year if requested by the employer (KT).

What are an employee’s annual leave entitlements?
For every year of service, an employee is entitled to annual leave of not less than the following:

1. Two days leave for every month if his service is more than six months and less than one year.

2. A minimum of thirty days annually, if his service exceeds one year. At the end of his service the employee is entitled to annual leave for the fraction of the last year he spent in service.
Annual leave is usually calculated on the basis of a calendar month rather than by working days. If an employee however fails to report back to work after the expiry of his leave period, his remuneration will automatically be forfeited for the days he is absent.

What would be payable to the employee during his annual leave?
An employee is paid his basic wage plus the housing allowance, if applicable, and any other allowances which he receives in the normal working month exclusive of any bonuses received.

Who determines when the annual leave commences and its duration?
The employer has the right to determine when an employee is allowed to take his annual leave and whether (if required) he is entitled to divide the leave into two parts.
If however, work circumstances require keeping the employee at work during the whole or part of his annual leave and the leave has not been carried over for the following year, the employer should pay the employee his wage in addition to a leave allowance for the days he worked equal to his basic wage.
In all cases, no employee should be required to work during his annual leave more than once during two consecutive years.
In other words, the employer may only defer the annual leave once in two consecutive years and at the same time pay the employee the annual leave wages.

When should annual leave wages be paid?

The employee should be paid his full wage before taking his annual leave, plus the wage of the leave days he has accrued.

Is the employee entitled to payment in lieu of leave if his services are terminated?
The employee is entitled to payment of his wages for the annual leave period not taken if his employment is terminated, or he resigns after serving the period of notice determined by law. Such payment is calculated on the basic wage received at the time the leave was due including any housing or accommodation allowance where applicable. Some employers also include transportation allowance in the calculation, although this is discretionary rather than compulsory.
Nevertheless, according to judgments delivered on the matter, an employee may only claim remuneration for the annual leave not taken for the last two years of employment at the rate of the wages paid during that time. Any leave days not taken prior to that period are therefore time barred and the employee is precluded from claiming remuneration against them (providing the employer relies on this time bar provision in the event of a claim).

I have been working in a company in the food industry for four years. I am eligible for my annual leave now. Last week, I applied for the leave, but my application was rejected by the office, saying that there are not enough staff at the moment. I would like to know if my company has the right to deny my annual leave.

Annual leave cannot be denied for two years
According to Article 78 of the federal labour law, if the work requires your stay in the country and prevents you from taking your leave, and if your leave is not carried forward to the next year, the employer has to pay you remuneration plus a leave allowance for the days you worked at a rate equal to your basic wages. Furthermore, this exception is not allowed more than once in two successive years.
Article 75 of the UAE Labour Law governs the annual leave of an employee. An employee is not entitled to an annual leave if his employment period is less than six months. However, if his employment period is more than six months but less than a year, he shall be entitled to an annual leave of not less than two days for each month.

However, if the employment period is more than a year, he is entitled to 30 days annual leave. Therefore, the duration of annual leave shall not be decreased as the right to annual leave is granted by the law. Article 75 states:

“The employee must be granted an annual leave during each year of service which may not be less than:

1. Two days per month with respect to any employee with more than six months and less than one year of service.

2. Thirty days per annum with respect to any employee whose period of service exceeds one year. In the event of termination of an employee’s service, he shall be entitled to an annual leave depending on the number of months completed in the last year of service.”

The employer has the right to specify the beginning of the annual leave and he can divide the leave into two parts, when necessary, in order to ensure smooth operation of the organisation/company. Article 76 states: “The employer, at his discretion, may determine the date for the commencement of annual leave and, when necessary, he may decide to divide the leave in two parts at the most, except in cases of juveniles, where vacation may not be divided in parts.”

In such an event, the leave may be forwarded to the next year, but it may not be suspended for more than two years and the employee will be entitled to sixty days annual leave in the next year if not paid in cash in lieu of the leave for his working days. Article 78 states: “The employee shall receive his basic pay in addition to housing allowance, if any, for the annual leave days. However, if the exigencies of work necessitate that the employee works during his annual leave in whole or in part, and the period of leave during which he has worked has not been carried forward to the next year, the employer ought to pay him his wage in addition to cash in lieu of the leave for his working days based on his basic pay.

“It shall be unlawful in any circumstances to employ a worker during his annual leave more than once in two successive years.”

I work as a school nurse here. Our employer said that during vacation, we will not receive any salary and that is for July and August. They will also not shoulder our accommodation charges. I am very worried because that is not what we agreed on or was written in the employment contract. They made us sign a waiver that we will have our two-month vacation without pay. Please advise.

Salary must not be deducted during vacation
As a general principle of law, a binding contract cannot be changed unilaterally. Article 267 of the UAE Civil Code states: “A binding contract cannot be changed unilaterally except with mutual consent of the parties or by an order of the court or by law”. Therefore, your employer does not have any legal right to deduct your salary or shoulder your accommodation charges if it is provided in your employment contract. Since you have signed the amended waiver, thus, it is binding upon you unless you prove that you have been forced to sign this waiver (KT).

NOTE: Hamriyah Free Zone, Sharjah, matters pertaining to employment is governed by the provisions of Federal Law No. 8 of 1980, relating to Regulation of Labour Relations (the “Labour Law”).

Jebel Ali Free Zone (Dubai)
The Free Zone Authority in Jebel Ali Port issues four types of licenses categorized by nature of the activity, namely:

• The trading license permits its holder to import, export, sell, distribute, and store all items specified on the license. However, sales of the company’s products in the UAE may be carried on only through an agent or distributor.

• The industrial license permits its holder to import raw materials and manufacture and export the finished product to any country. The manufactured product may be sold in the UAE through a distributor or agent.

• The holder of a service license must be licensed in one of the Emirates to render the samd services intended for its free tr`de zone operat)ons.

The national industrial license is issued to companies meeting the requirements for a National Production Certificate, ie, 40 per cent value added and 51 per cent Arabian Gulf Cooperation Bouncil (AGCC) ownershi` (Bahrain, Kuwait, Oman, Qatab, Saudi Arabia, and the UAE). Companies holding this type of license qualify for customs duty exdmption on their products imported into any of the above countries. Dubai International Airport Free Zone
Local Decree Number 2 of 1996 established a free zone at the Dubai International Airport. A company carrying on trade, services, or manufacturing (especially light industries) is permitted to incorporate or establish a branch in the Airport Free Zone. Most of the advantages and facilities offered to investors in the Jebel Ali Free Zone are offered to investors who establish business in the Airport Free Zone.

Dh220 should be paid at Immigration for file opening.
Dh5020 should be deposited at Immigration after visa approval. This amount is refundable after visa cancellation.
 
NOTE: If the wife's profession is other than the above mentioned, she can try through Humanitarian Case Committee at the Immigration Head Office, Jafliya, if her salary is Dh20,000 or above.
If the husband is inside UAE on visit or his previous visa cancelled, Dh1530 to be paid extra to change status (Dh1020 to issue visa inside the country and Dh510 for status change). Typing charge extra.
If the person is on Tourist Visa, he can get visa in hand on payment of Dh680 at Immigration and he should exit. Status Change is not possible for Tourist Visa. Visa change package is available from Fly Dubai, Air Arabia and some other airlines.

Four categories of women workers can sponsor family

The part-time work permit applies to three categories of persons:

1. Resident workers in full-time employment holding a valid labour card

2. Residents aged 18 and above

3. Government employees

NOTE: Part-time Work permit is not issued for female employees.
Those issued with a part-time work permit are not limited to the number of part-time jobs they can take up.

Cruise tourists, property owners and their families, businessmen and professionals can get multiple visit visas to the UAE. cruise tourists will be able to get three months multiple tourist visa and stay maximum of 14 days during each visit. Specific conditions need to be met to be eligible for the six month multiple visas.

• Businessmen and professionals abroad, who are dealing with a public or private institution or a company in the UAE, and who require frequent visits, are eligible for multiple entries for six months. They can enter the country as many times during this period.

• Multiple entry visas can be issued by any of the General Directorate of Residency and Foreigners Affairs in the country and the UAE’s mission abroad.

• Business visitors, who get multiple entries visas for six month should not stay more than 30 days during each visit.

• In case the purpose for visiting the country is tourism and the visitor is coming on board one of the cruises, the entry permit allow the tourist to enter the country several times during the three months from the date of issuance of the visa and stay a maximum of 14 days each time from date of entry.

• UAE’s ambassadorial and consular mission abroad can also issue a ‘special visa’ to specific categories of visitors. The UAE mission aboard are allowed to issue visit visas exempt from the requirement of a sponsor.

• Holders of diplomatic and United Nations passports can be given multiple entry visas for three months by UAE missions abroad.

• These visas allow entry to the UAE for multiple times during three months from the date of the issuance. It also allows the holder to stay during each of the visit for not more than 30 days from the date of entry as long as the visa is valid.

• Regular tourists are not entitled to multiple entry visas and must apply for visit visas.

The visitor must enter the UAE on a visit visa and obtain the multiple entry visa while he is here. Once this Multiple Entry Visa expires, businessmen have to wait for a month before applying for another Visa.

Citizens of 47 countries can get a 30-day visit visa free of charge upon arrival, entitling them to extend the Visa for further 30 days on payment of Dh640 (Dh500 Federal Fee + Dh100 Local Service + Dh40 Insurance) to be paid at typing centre. If not extended, 10 days grace will be given. If exceeds 40 days, Dh100 should be paid per day from 31st day.  Citizens of the following countries are entitled to get visa on arrival.

Britain, France, Italy, Germany, the Netherlands (Holland), Belgium, Luxembourg, Switzerland, Austria, Sweden, Norway, Denmark, Portugal, Ireland, Greece, Cyprus, Finland, Malta, Spain, Monaco, Vatican, Iceland, Andorra, San Marino, Liechtenstein, United States, Canada, Australia, New Zealand, Japan, Brunei, Singapore, Malaysia and Hong Kong. New EU visa exemptions apply to citizens of: Poland, Slovenia, Slovakia, the Czech Republic, Lithuania, Hungary, Latvia, Estonia, Malta, Cyprus, Croatia, Romania and Bulgaria from March 22, 2014 onward.

After this period a visitor can enter UAE on Visit Visa again by leaving the country and returning as much as they want. These visitors will be exempted from the refundable deposit.

GCC Residents who are not GCC nationals but who have a high professional status such as Managers, Business people, Auditors, Accountants, Doctors, Engineers, Teachers, Pharmacists, Sales Executives, Sales Representatives, Commercial Promoters and employees working in the public sector, their families, drivers and personal staff sponsored by them, are eligible for visa upon arrival at the approved ports of entry in UAE. Validity: 30 days. Fee: Dh185 should be paid at Airport. This visa is  renewable for further 30 days on payment of Dh640.

Administration staff like Secretary, Executive Secretary, Clerks are NOT eligible.

NOTE: If you are entering UAE from Oman through Hatta border, you have to pay Dh185 or 21 Omani Riyal. If you are entering UAE through Al Ain border, you have to pay Dh105.

If you do NOT fall into one of the above categories, you will require a visa and a sponsor for your visit. The sponsor normally applies for the visa on your behalf.

Valid sponsors may be as follows:-

a - Hotels & Tourist Companies can apply, on your behalf, for a Tourist Visa (valid for 30 days extendable for further 30 days); or a Service Visa (valid for 14 days); or a Visit Visa (valid for 30 days).

b - Airlines & Airlines Handlers apply on behalf of their crew members for a 96-hour Transit Visa.

c - Other Organizations based in the UAE may only apply for Visit Visas.

d - Individuals (Relatives or Friends) already resident in the UAE may, subject to guidelines, also apply on your behalf for a Visit Visa.

German Citizens
The German citizens (tourists and business people) may apply to the UAE embassy in Germany for a one or two year multiple-entry visa. No sponsor is required. The maximum duration of stay of visa holders should not exceed three months a year. The visa fee is Dh 1,500.

US Citizens
The US citizens (tourists and business people) may apply to the UAE embassies in the US for one to ten year multiple-entry visas. A sponsor is required and the visa will be granted free of charge. The maximum duration of stay should not exceed six months a visit.

Oman Visa: GCC Residents who are not GCC nationals but who have executive professional status are eligible for a non-renewable 28-day visa upon arrival at the approved ports of entry in Oman. UAE residents can enter through Hafeet border post.

STEPS TO FOLLOW
Put signature of the sponsor on the application.
Submit the application along with original passport and Emirates ID at the Immigration. Visa will be cancelled the same time.
There are 30 days grace period from the date of Visa expiry. Applicant can stay in UAE 30 days from the date of cancellation if his/her visa was not expired at the time of cancellation. If the cancellation done during the grace period, remaining days will be allowed to stay without fine. If the the cancellation done during overstay period, 6 days will be granted from the date of cancellation.
Fine Dh25 per day will be calculated for Residence visa overstay if change status inside the country. Dh75 per day to be paid if exits. Fine can be paid at Immigration or Airport at the time of exit.
No Ban for residence/family visa holders at the time of cancellation.

CANCELLATION BEFORE STAMPING THE VISA
Q: My family came to Dubai last month. Medical and Visa stamping not yet done. Due to health problems they want to go back home without stamping Visa. Do I need to cancel their visa in this case?
A:
Yes, you have to cancel their visa. Required Documents: Original passport and Visa of family and your passport copy.
Type the application from Typing Centre and submit at Immigration. Same time they will cancel the visa. Fees: Dh160 for Urgent (typing charge extra). They can stay here the remaining days to complete 60 days from the date of entry. But maximum 29 days.

OUT OF COUNTRY CANCELLATION

If the family members are out of UAE, apart from the above mentioned procedures, Dh130 to be paid at Immigration office to take print out of exit details. Passport copy of family is enough. But Dhs130 can be saved for each member if the original passport is brought.

Special requirements for Ajman family Visa
• Sworn Affidavit from Ajman Sharia Court. Expatriates must approach the Sharia court with two Muslim witnesses to establish that they have a legal relationship with the woman they wish to sponsor. The witnesses must be Muslims, irrespective of the religion of the sponsor and those sponsored. The two witnesses must swear on the Quran in front of the judge that the woman for whom the visa is sought is the wife of the person sponsoring her. This is applicable for both visit visa and residence visa for wife/children/parents. Fees: Dh350. Affidavit can be typed from Typing Centre.

• Affidavit (sponsorship declaration) from the applicant's Consulate and attest it from Ajman Sharia Court. Indian nationals can make this affidavit through Ajman Indian Association. Tel. +971-6-7474212.

Attest marriage certificate at Ajman Sharia court in addition to getting it attested at the UAE embassy in home country and Ministry of Foreign Affairs in UAE.
Visa application fee: Dh140 (can be prepared from Typing Centre) STATUS CHANGE: If family is inside the country, type Status Change form from Typing Centre after get issued the Visa from Immigration.
FEES: Dh550 to be paid at Typing Centre. Then sign the form and submit it at the Immigration. It can be completed same time. Then type Emirates ID, Medical and Visa Stamping forms from Typing Centre.
Visa holder should enter UAE within 60 days from the date of issue and should complete Emirates ID, Medical and Visa Stamping within 60 days from the date of entry/status change.

Please note that, in Dubai, this facility is subject to special approval from senior officer at Immigration head office, Jafliya. Approval depends on your new Designation and Salary mentioned in the job offer letter. New salary should be Dh20,000 or above.
If approved, Family visa can be held without canceling, while changing sponsor's visa to another company. Benefit of this facility is, dependents can continue their existing visa and you can avoid expense of Cancellation, Applying new visa, Status change, Medical, Emirates ID and Visa stamping. DUBAI TO DUBAI (MAINLAND):
If you are changing visa from a private company to another company in Dubai mainland, do the following steps:
Cancel your labour Card from Tas'heel Centre
Get job offer letter in Arabic from the new company
Take labour card cancellation receipt, Arabic offer letter, Original passports of you and your family to Immigration head of office in Jafliya. Pay Dh5020 as deposit.
Dh130 extra to be paid at Immigration as service charge for each dependent's Passport.
Immigration Department will issue a receipt for the deposited amount and will cancel your visa without cancelling family's visa. You have to make ready your visa cancellation paper with you.
Now your new company can apply for your Work Permit and complete the procedure.
NOTE: New company can't apply for your new work permit before you cancel your old labour card and visa in the passport.
NOTE: Period of Visa holding is 30 days. Can be extended for further 30 days by written request to Immigration Department. After that fine will be charged.
Your dependents cannot travel during the visa hold period.
After get issued the Visa, you have to change Visa Status, apply for Medical, Emirates ID, labour contract and Visa Stamping.
You must show your new labour contract and new visa stamped passport at Immigration Department to refund the money.
REFUND PROCEDURES

If you are changing visa from a Free Zone to Dubai mainland company, do the following steps:
Let the new company apply work permit for you After the approval from Ministry of Labour, submit the work permit and appointment letter to Immigration Department and deposit Dh5020 to hold your dependents visa.
Dh130 extra to be paid at Immigration as service charge for each dependent's Passport.
Immigration Department will issue a receipt for the deposited amount and will cancel your visa without cancelling family's visa.
Now new company can get your visa from Immigration after completion of the the formalities.

NOTE: Period of Visa holding is 30 days. Can be extended for further 30 days by written request to Immigration Department. After that fine will be charged. If the allowed period exceeded, the applicant cannot change status inside the country and he/she must exit and enter on new visa. In such case he/she can exit to Oman or home country after receiving the new visa (Fly Dubai package is available for visa change).
Your dependents cannot travel during the visa hold period.
After get issued the Visa, you have to change Visa Status, apply for Medical, Emirates ID, labour contract and Visa Stamping.
You must show your new labour contract and new visa stamped passport at Immigration Department to refund the money.

CHANGING TO INVESTOR/PARTNER VISA: If you are changing to Investor/Partner Visa, type the application, get seal and signature of sponsor, submit the application at the immigration Head Office, Jafliya, pay Dh10,000 as Investor/Partner visa deposit, Dh680 to issue visa inside the country, Dh5020 as refundable deposit to hold dependants visa and Dh130 service charge for each dependent's Passport.

Investor/Partner Visa holder needs to show his/her new visa stamped passport only to refund the money.
Family visa needs to renew only at the time of its expiry. No need transfer.
Family visa holding is not allowed if the applicant is shifting to different emirate.

Cancel your dependents visa first from Immigration. They can stay here 29 days after cancellation without fine if the present visa is not expired at the time of cancellation
Now your present company can cancel your own visa and let your new company apply work permit for you. You can stay here 29 days after cancellation without fine if the present visa is not expired at the time of cancellation
After completion of all payments of Ministry of Labour, pay inside the country fee for Immigration. Dh650 is the extra fee to get visa inside the country
Type Status Change form from Typing Centre and pay Dh570 (service charge extra)
Do medical test, type labour contract from Tas'heel Centre and submit the Contract at Tas'heel Centre after signing employee and employer. If you pay Dh53 extra at Tas'heel Centre you can collect your labour contract and labour card by next working day from the same Tas'heel Centre.
Type Emirates ID and Visa Stamping from Typing Centre, attach original Visa, Medical Certificate, Passport, copy of Emirates ID application, Labour Contract submission receipt copy, Immigration Establishment Card copy, Trade License copy and submit at Immigration office. You can select urgent mode at the time of typing Visa Stamping application by paying Dh100 extra or pay Dh130 extra at Immigration to make it urgent. You will get back visa stamped passport same time.
Pay Dh20 for Courier if the Application is Normal and Passport will be delivered after Two days
No you can apply for family/dependents visa and change their status inside the country without exit.
